Annual Notice Requirements – These required annual notices are provided to employees by their employer to inform employees of their rights regarding their health and welfare benefit plans. Examples of these notices include Medicare Part D Notice of Creditable Coverage, CHIP, WHCRA, ADA Wellness Program, HIPAA, etc.

Medicare Part D Creditable Coverage Disclosure - The Medicare Modernization Act (MMA) requires certain employers offering prescription drug coverage to disclose whether the prescription drug coverage under the plan is “creditable", meaning that the plan’s prescription drug coverage is creditable if the actuarial value of the coverage equals or exceeds the actuarial value of standard prescription drug coverage under Medicare Part D.

Gag Clause Attestation - A Gag Clause Prohibition Compliance Attestation (GCPCA) is a yearly attestation that group health plans and health insurance issuers must submit confirming their compliance with the gag clause prohibition. The attestation is necessary to comply with the Internal Revenue Code, Employee Retirement Income Security Act, and Public Health Service Act requirements.
